This promotion is in no way sponsored, endorsed or administered by, FSMTA. To participate in American 3B Scientific’s FSMTA Giveaway you must agree to and abide by these Official Rules:
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. INTERNET ACCESS AND A VALID E-MAIL ACCOUNT REQUIRED.
1. Giveaway Entry: The Giveaway begins on or about 00:00:00 a.m. (“EST”) on June 28, 2012 and ends 03:59:00 p.m. (“EST”) on June 30, 2012. Sponsor’s computer is the official clock for this Giveaway. Enter the give away by going to the URL xxx or send an email to offers@a3bs.com.
Carefully read the Official Rules as entry implies you have read, fully understand, and agree to these Official Rules.
Your Entry Information will together constitute your entry into this Giveaway (“Entry”). By making an Entry into the Giveaway you consent to receive promotional e-mails, newsletters, and membership appeals from the Sponsor, and you also consent to receive promotional e-mails from our affinity partners. Consenting to receive promotional e-mails, newsletters, and membership appeals from the Sponsor and affinity partners of the Sponsor does not improve your chances of winning. You may opt out of receiving promotional e-mails, newsletters, and membership appeals at any time.
You are limited to one (1) Entry per account for the duration of the Giveaway. Day is defined as the 24-hour time period of one calendar date. Multiple entries in excess of this limitation or mass entry attempts will result in disqualification of all entries in this Giveaway by such person or from such e-mail address. Sponsor will not be responsible for late, lost, incomplete, or misdirected Entries. Proof of submission of an Entry does not constitute proof of receipt of same. All Entries become the property of Sponsor and will not be returned or acknowledged. By entering this Giveaway, each entrant agrees to these Official Rules and the decisions of the Sponsor, which are binding and final in all matters relating to this Giveaway.
2. Eligibility: The Giveaway is open only to legal residents of the 48 contiguous United States and the District of Columbia, who are 18 years of age or older as of the date of entry. Void in Alaska, Hawaii, Guam, Puerto Rico, U.S. Virgin Islands, and other U.S. Territories, and where prohibited or restricted by law. 3B Scientific employees and their immediate family members are not eligible to enter. “Immediate family members” shall mean parents, step-parents, children, step-children, siblings, step-siblings, grandchildren, step-grandchildren, or spouses, regardless of where they live. “Household members” shall mean people who share the same residence at least three consecutive months a year, whether related or not.
3. Grand Prize (1 winner): One Giveaway winner will receive an W60602B Deluxe Portable Massage Table - Blue directly from or through American 3B Scientific.
The prize may not be sold, traded, transferred, assigned, refunded, exchanged, commissioned or redeemed for cash value. Prize elements may not be substituted and are non-commissionable. The total retail value of the Giveaway is $275 USD. All benefits and payments are personal to the winner and are not redeemable for cash and neither assignable nor transferable. LIMIT ONE PRIZE PER PERSON/FAMILY/HOUSEHOLD.
Prize elements may be subject to additional restrictions. Any portion of a prize not accepted or used by a winner will be forfeited, and the Releases (as hereinafter defined) shall not be responsible for any inability of winner to accept or use any portion of the prize for any reason. Odds of winning depend on the number of eligible entries received. All taxes are the sole responsibility of the winner, who must report the actual retail value of the prize on his/her current tax year income return(s). Winner will receive, upon written request to A3BS Flintstone Dr, Unit O, Tucker, GA 30084 an IRS Form 1099 reporting the Sponsor’s good faith determination of the retail value of the prize.
4. Validation/Winner Selection: Winners will be randomly selected on June 30, 2012 from among all eligible entries received. A potential winner will be notified on Facebook and by e-mail. If a potential winner does not reply to such notification within 120 hours, or an e-mail notification is undeliverable after up to three attempts, then winner will be disqualified. In the event of any dispute concerning the identity of any participant, the Entry will be deemed submitted by the natural person who is the authorized holder of the transmitting e-mail account. “Authorized holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. If, for any reason, the prize is not claimed, or a winner is disqualified, then an alternate potential winner of the prize may be selected in a random drawing from remaining eligible entries received. The winner must pick up the prize in 3B Scientific's booth at FSMTA 2012 #705 before 6pm on June 30, 2012. If the winner has to pay for shipping charges if he/she is unaible to pick the prize up at the show.
If the Giveaway is not capable of running as planned for any reason including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, human error, technical failure, laws and regulations, or other causes that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Giveaway (in whole or in part), Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify and/or suspend the Giveaway or take any other action Sponsor deems necessary or advisable in keeping with the structure and integrity of the Giveaway including, at Sponsor’s sole discretion, selecting a winner from all eligible Entries received prior to the action taken, or as otherwise deemed fair and equitable by Sponsor. Notice of such action by Sponsor will be posted on a3bs.com. No responsibility is assumed by Sponsor or Administrator for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to or alteration of Entries; or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any e-mail or electronic Entry to be received on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof, including, but not limited to, any injury or damage to participant’s or any other person’s computer related to, or resulting from, participation in or downloading any materials from this Giveaway. Sponsor reserves the right to disqualify from participating in this Giveaway any individual who tampers with the entry process, violates these Official Rules, or acts in a manner disruptive or abusive of the Giveaway. Entrants further agree not to knowingly damage or cause interruption of the Giveaway and/or prevent others from using the Giveaway. Submission of an Entry is acknowledgement of, and agreement to be bound by, all terms and conditions of this Giveaway.
5. Additional Terms: By entering the Giveaway, each entrant agrees to release, discharge and hold harmless Sponsor, American 3B Scientific, and each of their respective related, parent, subsidiary or affiliated companies, advertising and promotional agencies and prize suppliers, and each of their respective officers, directors, employees, agents and representatives (collectively, the “Releasees”), from any and all claims and liabilities arising from or relating to entrant’s participation in the Giveaway or any Giveaway related activity (including, but not limited to, travel) and/or entrant’s acceptance, use, or misuse of the prize or any part thereof. By entering, each entrant further agrees that the Releasees have not made any warranty, representation or guarantee, express or implied, in fact or law, with respect to the prize, including without limitation, to such prize’s quality or fitness for a particular purpose.
6. Disputes/Choice Of Law: Except where prohibited, and subject to the release and waiver of claims provision herein, entrants: (1) agree that any and all disputes, claims, and causes of action arising out of or connected with the Giveaway, (excluding any and all disputes, claims, and causes of action arising out of or connected with any prize awarded or the use thereof), or the determination of the winner, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration pursuant to the Rules of the American Arbitration Association, then effective, and (2) waive any right to seek or obtain injunctive or other equitable relief, and (3) agree that any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering Giveaway, but in no event attorneys’ fees; and (4) agree that under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and/or Sponsor and Administrator in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of Georgia, without regard for conflicts of law doctrine of Georgia or any other jurisdiction, and all proceedings shall take place in Atlanta, Fulton County, Georgia. Except where prohibited, and subject to the release and waiver of claims provision herein, entrants agree that any and all disputes, claims, and causes of action arising out of or connected with any prize awarded in the Giveaway or the use thereof shall be resolved individually, without resort to any form of class action, and exclusively before the District Court for District Eleven of Georgia (Fulton County).

9. Name of Prize Winner: For the name of the prize winner, available after June 30, 2012, mail a self-addressed, stamped envelope to: American 3B Scientific, Attn. Marketing Manager, 2189 Flintstone Dr., Unit O, Tucker, GA 30084. Requests received after July 15, 2012 will not be honored.
